Terms Services Provider
1. Introduction & Legal Entity
These Terms and Conditions (“Terms”) govern access to and use of the Hukit mobile application, website, and related services (collectively, the “Platform”). The Platform is owned and operated by Black Hoofs, a business registered in the Republic of Maldives (“Hukit”, “we”, “us”, or “our”). Hukit provides a technology-based marketplace enabling Users to connect with independent service providers (“Providers”). Hukit does not provide services directly and does not employ, supervise, or control Providers.
2. Definitions
“User” refers to any individual or entity seeking services through the Platform.
“Provider” refers to any independent individual or business offering services via the Platform.
“Platform” means the Hukit App and all related digital services.
“Subscription” means a plan offered to Providers for platform access.
“Commission” means a plan offered to Providers for platform access.
“Referral Reward” means any incentive paid directly by Hukit from its own revenue.
3. Nature of the Platform
Hukit is a neutral technology intermediary. Hukit does not guarantee service quality, completion, pricing, or outcomes. All service agreements are formed solely between Users and Providers. Hukit is not a party to such agreements.
4. Eligibility & Compliance
Users and Providers can be of any age. Providers under 18 require to fill the parent consent form provided on Hukit App Website. Providers must comply with all applicable Maldivian laws, licensing, permits, and tax obligations. Foreign Providers must hold valid work permits where required. If you are accessing Hukit on behalf of a company, agency, or organization, you represent and warrant that you are authorized to bind that entity to these Terms.
5. Accounts & Security
Account holders are responsible for safeguarding login credentials and all activity under their accounts. Hukit may require identity verification and may suspend or terminate accounts for inaccurate or misleading information. Notify Hukit immediately of any unauthorized access or breach of security. Hukit will not be liable for any loss or damage arising from your failure to protect your credentials.
6. User Rights & Obligations
Users may browse, post jobs, and engage Providers through the Platform. Users must engage respectfully, make payments as agreed, and comply with applicable laws. Users may not demand outcomes, guarantees, or liability coverage from Hukit.
7. Provider Rights & Obligations
Providers operate as independent contractors. No employment, agency, partnership, or fiduciary relationship exists. Providers are solely responsible for service execution, quality, safety, insurance, taxes, and compliance. Hukit reserves the right to remove or disable any content that violates these Terms or applicable laws. Any loss or damage caused by a provider is the provider’s responsibility. Optional insurance may be offered annually.
8. Subscriptions & Fees
Providers operate as independent contractors. No employment, agency, partnership, or fiduciary relationship exists. Providers are solely responsible for service execution, quality, safety, insurance, taxes, and compliance. Hukit reserves the right to remove or disable any content that violates these Terms or applicable laws. Any loss or damage caused by a provider is the provider’s responsibility. Optional insurance may be offered annually.
9. Referral Program
The referral program is single-level only. Rewards are paid solely from Hukit revenue. No recruitment obligation exists. No downstream or network-based earnings are permitted. Referral rewards cease automatically upon subscription termination of any parties.
10. Experience Letters
Experience Letters reflect platform activity only and do not constitute employment verification, skill certification, or endorsement. Experience Letters are given only to those who have been actively providing service on Hukit for 4 months or more.
11. Content & Intellectual Property
Users retain ownership of their content but grant Hukit a non-exclusive license to use it for platform operations. All Platform intellectual property remains the property of Hukit or its licensors.
“User Content” refers to any data, information, images, videos, text, or materials you upload, submit, or display on the Platform, including your name, profile photo, services, past work, and social media links, which you retain ownership of, while granting Hukit a non-exclusive, worldwide, royalty-free license to use, host, store, display, and distribute such content solely for the purposes of operating and improving the Platform.
Certain details, including your name, profile photo, listed services, past work, and social media links, may be visible to other users to facilitate professional discovery and connections. Sensitive information such as identification documents, date of birth, and verification materials (including qualification and experience certificates) are kept strictly confidential and are never displayed publicly.
12. Prohibited Activities
Users must not use the Platform for any unlawful, fraudulent, deceptive, or misleading purposes. You may not post, share, or transmit content that is false, defamatory, obscene, offensive, or harmful, or that violates the rights of others, including intellectual property and privacy rights.
Harmful conduct is strictly prohibited, including but not limited to hate speech, discrimination, harassment, bullying, or abuse. Users are also prohibited from attempting to bypass security measures, accessing information without authorization, using automated tools such as bots or scrapers without prior written approval, or impersonating any individual or organization or falsely representing their identity or affiliation.
13. Off-Platform Transactions
Hukit bears no responsibility for disputes or transactions arising from communication or payments outside the Hukit App.
14. Dispute Handling
Disputes between Users and Providers are their sole responsibility. Hukit may offer optional mediation without obligation.
15. Suspension & Termination
Hukit may suspend or terminate accounts immediately for violations, without compensation.
16. Disclaimers
The Platform is provided “as is” and “as available”. Hukit disclaims all warranties to the maximum extent permitted by law.
17. Limitation of Liability
Hukit’s total liability shall not exceed the fees paid to Hukit in the preceding six months. Indirect or consequential damages are excluded.
18. Indemnity
Users and Providers agree to indemnify and hold Hukit harmless from claims arising from their conduct or violations.
19. Privacy & Data Protection
All personal data is collected, processed, and safeguarded in accordance with the Privacy Policy and Data Safety Policy, which form an integral part of these Terms. Sensitive information, including identification details and date of birth, is kept strictly confidential. Only limited information such as name, profile photo, listed services, past work, and social media links is visible to other users.
20. Third-Party Services
The Platform may include links or integrations with third-party services or websites. Hukit is not responsible for third-party content, policies, or practices. Use of third-party services is governed by their respective terms.
21. Amendments
Hukit may update these Terms at any time. Continued use constitutes acceptance.
22. Governing Law & Jurisdiction
These Terms are governed by the laws of the Republic of Maldives. Courts of Maldives have exclusive jurisdiction.
23. Entire Agreement
These Terms, together with the Privacy Policy and Data Safety Policy, constitute the entire agreement between you and Hukit.
